Appeals of divorce judgments, restraining orders, or post-divorce issues like alimony or child support modifications go to a higher court, where judges serve a different role than at trial. Either party may appeal if dissatisfied and certain procedural requirements are met.

Dennigan Cahill Smith helps clients appeal trial court decisions, including meeting the 45-day deadline. If the judgment isn’t “final,” extra steps may be needed before filing. Until replaced, the original court order remains in effect. You can request a pause (or “stay”) during the appeal by filing a motion with the trial court.

If you have serious concerns about a trial court judgment or order, in that the Court did not base the opinion on substantial credit evidence, that the decision failed to follow the controlling legal principles or that there was an abuse of judicial discretion, you might want to explore whether an appeal makes sense.  Just like other legal matters, the total cost of the appeal depends heavily on the complexity of the issues, the legal research involved, and the length of the trial court proceeding.
