Divorce Litigation
Divorce court is far less entertaining than television makes it seem. For clients, it is often stressful and time-consuming, requiring many hours of preparation. Our attorneys are seasoned and knowledgeable, and they know how to prepare clients thoroughly for litigation. That said, most clients are understandably reluctant to pursue divorce litigation when other effective options are available.
In some cases, however, litigation becomes necessary. Clients may need to act to protect their rights, defend themselves, or safeguard their children. Delaying litigation can sometimes increase the risk of unfavorable financial outcomes or negatively affect related legal issues, such as those involving small businesses. In matters involving domestic violence, there are additional and important considerations, which are discussed below.
How should assets be divided? Should the couple’s home be sold? Are the children safe in the care of each parent? Who decides where a child goes to college—and who pays? Is one spouse entitled to alimony? If so, how much? For how long? What about credit card debt?
Before a Judge can rule on these kinds of issues, or make any decisions, evidence must be presented to the court that complies with certain legal rules. Our attorneys work hard to assist you in identifying the evidence you have, assist you in compiling and presenting it to the court, and in critically assessing opposing claims and evidence.
